La Resolución 0337-2024/SEL-INDECOPI sobre publicación de normas: ¿Precedente obligatorio o simple interpretación?

Abstract

La cuestión central consistió en determinar si el pronunciamiento emitido por la Sala Especializada en Eliminación de Barreras Burocráticas del INDECOPI, constituyó en un precedente o si, por el contrario, podría encajar en una figura distinta dentro del marco jurídico aplicable. Con ese propósito, se analizó el pronunciamiento de dicha sala, la fundamentación jurídica usada para establecer criterios generales y la aclaración expresa de su ámbito de aplicación y vigencia.

Del análisis realizado surgieron diversos factores, los cuales muestran que, en términos de contenido y voluntad institucional, pretende convertirse en precedente; sin embargo, su efectividad práctica dependerá de su reconocimiento y aplicación en casos futuros.

Para elaborar este trabajo se utilizaron como fuentes principales el expediente administrativo en cuestión y la normativa e interpretación contenida en él, complementados con doctrina y disposiciones sobre precedentes y publicidad de actos administrativos, aplicando una metodología que combina análisis doctrinal, comparación normativa y examen detallado del texto decisorio para determinar si corresponde calificarlo como precedente.

Es así que, pudimos concluir que los precedentes contienen criterios que si bien es cierto son interpretativos, estos son novedosos o aclaratorios que guían la actuación de la administración; sin embargo el denominado precedente de observancia obligatoria emitido por la Sala, no contempla las características sustanciales establecidas para ser considerado como dicha figura, toda vez que se limita a tratar criterios que ya han sido establecidos, lo que impide que cumpla con el objetivo de orientar en el sistema administrativo.

The central issue consisted of determining whether the pronouncement issued by the Specialized Chamber for the Elimination of Bureaucratic Barriers of INDECOPI constituted a precedent or, on the contrary, could fit within a different legal figure under the applicable legal framework. To that end, the chamber's pronouncement was analyzed, the legal reasoning used to establish general criteria, and the explicit clarification of its scope of application and effectiveness.

The analysis revealed several factors indicating that, in terms of content and institutional intent, it seeks to become a precedent; however, its practical effectiveness will depend on its recognition and application in future cases.

For the preparation of this paper, the main sources used were the administrative file in question and the regulations and interpretation contained therein, supplemented with doctrine and provisions on precedents and the publicity of administrative acts, applying a methodology that combines doctrinal analysis, normative comparison, and a detailed examination of the decision text to determine whether it should be classified as a precedent.

Thus, we concluded that precedents contain criteria that, although interpretive, are novel or clarifying and guide the administration's conduct; however, the so-called binding precedent issued by the Chamber does not meet the substantial characteristics required to be considered such a figure, since it is limited to addressing criteria that have already been established, which prevents it from fulfilling the objective of providing guidance within the administrative system.
