Análisis de los límites constitucionales de la delegación legislativa y su afectación al secreto bancario

Abstract

La presente investigación analiza los límites constitucionales de la delegación de facultades legislativas en materia tributaria frente a la afectación al secreto bancario, a raíz de la Sentencia N° 922/2021, mediante la cual el Tribunal Constitucional declaró infundada la demanda de inconstitucionalidad interpuesta contra los Decretos Legislativos N° 1313 y N°1434. Dichas normas, en el ejercicio de sus facultades delegadas, modificaron la Ley N° 26702, con la finalidad de otorgar acceso a la Sunat a la información financiera de los usuarios.

En el estudio, se identifica que el Decreto Legislativo N° 1313 respeta los límites formales y materiales de la delegación legislativa, al mantener el control judicial, mientras que el Decreto Legislativo N° 1434, excede tales límites al permitir el acceso directo de la Sunat a información referida a saldos montos, rendimientos y promedios, manifestando que constituyen información global no protegida por el secreto bancario, lo que excede el marco constitucional y genera una tensión entre la Constitución, como norma constitucionalmente estatuida, y la ley delegada, como norma constitucionalmente adscrita.

El presente análisis se estructura en tres ejes: i) el cumplimiento de los límites formales de la delegación legislativa, en cuanto a plazo, materia, procedimiento y autoridades facultadas; ii) la evaluación de los límites materiales y el respeto del contenido esencial del secreto bancario frente al acceso directo de la Sunat; y iii) la aplicación de los principios de supremacía constitucional y pro hominem como criterios para dilucidar la tensión normativa y determinar la prevalencia de la Constitución.

This research analyzes the constitutional limits of delegated legislative powers in tax matters and their impact on the protection of banking secrecy, based on Constitutional Court Judgment N° 922/2021, which declared unfounded the claim of unconstitutionality filed against Legislative Decrees N° 1313 and N° 1434. These decrees, issued under delegated powers, amended Law N° 26702 with the purpose of granting the National Superintendence of Customs and Tax Administration (Sunat) access to users' financial information.

The study identifies that Legislative Decree N° 1313 complies with the formal and material limits of legislative delegation by maintaining judicial oversight, while Legislative Decree N° 1434 exceeds such limits by allowing Sunat direct access to information on balances, amounts, returns and averages, claiming that these constitute “global information” not protected by banking secrecy. This interpretation exceeds the constitutional framework and generates tension between the Constitution, as a constitutionally enacted norm, and the delegated law, as a constitutionally enacted norm, and the delegated law, as a constitutionally ascribed norm.

The analysis is structured around three axes: i) compliance with the formal limits of legislative delegation, regarding timeframe, subject matter, procedure, and competent authorities; ii) evaluation of material limits and respect for the essential content of banking secrecy in the face of Sunat's direct access; and iii) the application of the principles of constitutional supremacy, pro hominem, and material truth as criteria to resolve the normative tension and determine the primacy of Constitution.
