Competencias en Tránsito y Transporte: Limites al Poder Municipal en STC Exp. N° 00002-2023-PI/TC

Abstract

El presente Trabajo de Suficiencia Profesional tiene por objeto analizar la Sentencia emitida por el Tribunal Constitucional recaída en el Expediente Nº 00002-2023-PI/TC, a través de la cual se declara fundada en parte la demanda de inconstitucionalidad interpuesta por la Defensoría del Pueblo contra distintas ordenanzas municipales que contenían múltiples infracciones que tenían por fin regular el tránsito y transporte en diversos distritos de Lima Metropolitana tras carecer de competencia para sancionar dichas conductas. De manera que, se revisarán los fundamentos del Tribunal Constitucional, mismos que sustentaron el fallo de la sentencia objeto de estudio, al igual que, los argumentos de los votos singulares a fin de entender la aplicación de los límites competenciales entre los gobiernos locales y el Ministerio de Transportes y Comunicaciones, todo ello enfocado en el ámbito de fiscalización y sanción en materia de tránsito y transporte. Asimismo, se analizará la relevancia de los principios constitucionales de publicidad normativa y legalidad, al igual que, se estudiará su alcance como pilares que garantizan la adecuada delimitación de competencias entre las instituciones estatales previamente mencionadas. Para cumplir con dicho propósito, se realizó una clasificación meticulosa de las fuentes bibliográficas y referencias detalladas dentro de libros, artículos científicos y marco normativo. En consecuencia, ante todo lo expuesto, consideramos necesaria la modificación del artículo 81 de la Ley Nº 27972, Ley Orgánica de Municipalidades, respecto a la regulación de las facultades de los gobiernos locales en materia de tránsito y transporte a fin de evitar el conflicto de competencias.

The purpose of this Professional Proficiency Project is to analyze the ruling issued by the Constitutional Court in Case No. 00002-2023 -PI/TC, which partially upheld the constitutional challenge filed by the Ombudsman's Office against various municipal ordinances containing multiple violations aimed at regulating traffic and transportation in various districts of Metropolitan Lima, despite lacking the authority to sanction such conduct. Therefore, the grounds of the Constitutional Court, which supported the ruling under review, will be examined, as well as the arguments of the individual votes, in order to understand the application of the limits of competence between local governments and the Ministry of Transport and Communications, all focused on the area of oversight and sanctioning in matters of traffic and transportation. Likewise, the relevance of the constitutional principles of regulatory publicity and legality will be analyzed, and their scope as pillars that guarantee the adequate delimitation of powers between the aforementioned state institutions will be studied. To achieve this purpose, a meticulous classification of bibliographic sources and detailed references in books, scientific articles, and the regulatory framework was carried out. Consequently, in view of the foregoing, we consider it necessary to amend Article 81 of Law No. 27972, the Organic Law on Municipalities, with regard to the regulation of local governments' powers in matters of traffic and transportation in order to avoid conflicts of jurisdiction.
