Temporalidad de la Notoriedad Marcaria: Análisis Crítico de la Resolución 0330-2024/TPI-INDECOPI

Abstract

El presente trabajo examina el precedente de observancia obligatoria establecido por la Sala Especializada en Propiedad Intelectual del Tribunal del Indecopi (en adelante, “SPI”) mediante la Resolución 0330-2024/TPI-INDECOPI (2024). Dicha resolución estableció un criterio administrativo vinculante respecto de las marcas notoriamente conocidas, al determinar que el plazo máximo para invocar la notoriedad de un signo distintivo es de cinco años contados desde la fecha en que la autoridad reconoce tal condición. Transcurrido dicho plazo, el titular de la marca notoriamente conocida deberá acreditar nuevamente que su signo conserva esa calidad, a fin de verificar si mantiene su carácter notorio. Para el desarrollo del presente estudio se revisan los antecedentes del caso, la normativa aplicada por la autoridad administrativa y las disposiciones pertinentes relativas a la protección de las marcas notoriamente conocidas en el ordenamiento jurídico peruano. Asimismo, se desarrollan los conceptos de marca, marca notoria, marca renombrada y marca famosa. Posteriormente, se analiza la jurisprudencia vinculada a la protección de las marcas notoriamente conocidas, así como el uso de doctrina especializada que refuerza los fundamentos legales y económicos de la notoriedad marcaria.

En esa línea, el trabajo plantea una crítica jurídica al criterio asumido por la SPI, que sustentó su decisión en los conceptos de realidad y dinamismo del mercado. A juicio del presente estudio, tales conceptos no fueron desarrollados adecuadamente y resultan insuficientes para justificar la imposición de un límite temporal a la notoriedad marcaria, considerando la relevancia económica y jurídica que este posee en el mercado.

The present study examines the binding precedent established by the Specialized Chamber for Intellectual Property of the Tribunal of Indecopi (hereinafter the SPI) through Resolution 0330-2024/TPI-INDECOPI (2024). This resolution set forth a binding administrative criterion regarding well-known trademarks, stating that the maximum period for invoking the notoriety of a distinctive sign is five years from the date the authority recognizes its status. After this period has elapsed, the owner of the well-known trademark must once again demonstrate that the sign retains well known status to confirm whether it continues to be recognized as such. To conduct this study, we review the background of the case, the legal framework applied by the administrative authority, and the relevant provisions regarding the protection of well-known trademarks within the Peruvian legal system. Likewise, the study addresses the concepts of trademark, well-known mark, renowned mark, and famous mark. Subsequently, it analyzes case law related to the protection of well-known trademarks, as well as specialized legal doctrine that reinforces the legal and economic foundations of trademark notoriety. In this context, the paper presents a legal critique of the criterion adopted by the Specialized Chamber, which based its decision on the concepts of market reality and dynamism. However, these concepts were not adequately developed and are insufficient to justify the imposition of a temporal limit on trademark notoriety, given the significant economic and legal importance that such distinctive signs have in the market.
