Vacancia por Incapacidad Moral: Análisis y Necesidad de Establecer Criterios para Evitar su Uso Arbitrario

Abstract

La presente investigación analiza la sentencia emitida por el Tribunal Constitucional, recaída bajo el Expediente N° 00002-2020-CC/TC, mediante la cual se declaró improcedente la demanda competencial interpuesta por el Poder Ejecutivo contra el Congreso de la República. Esta controversia se originó por la admisión a trámite de la Moción de Orden del Día N° 12090, que tenía por objeto promover la vacancia del entonces presidente Martín Alberto Vizcarra Cornejo bajo la causal de incapacidad moral permanente, prevista en el inciso 2 del artículo 113 de la Constitución. El estudio se centrará en el análisis de la figura de la vacancia presidencial por incapacidad moral permanente, desarrollando fundamentos conceptuales y doctrinarios vinculados al caso, obtenidos mediante fuentes bibliográficas, doctrina y jurisprudencia vinculadas a las distintas posturas respecto a la interpretación de esta figura. En ese sentido, el análisis de la sentencia del Tribunal Constitucional reviste de especial relevancia jurídica, al evidenciar la necesidad de delimitar el alcance de dicha figura, mediante criterios normativos verificables que fortalezcan la seguridad jurídica y reduzcan las interpretaciones dispares dentro del Parlamento, con la finalidad de conservar un gobierno con estabilidad democrática. Por ello, el presente trabajo propone la modificación del artículo 113 de la Constitución y del artículo 89-A del Reglamento del Congreso incorporando una definición objetiva, así como parámetros interpretativos uniformes que aseguren la aplicación excepcional y coherente de la vacancia presidencial, evitando así que dicha figura se aplique de manera arbitraria y, fortaleciendo el equilibrio de poderes en nuestro sistema político.

This research analyzes the ruling issued by the Constitutional Court in Case No. 00002-2020-CC/TC, which declared inadmissible the jurisdictional challenge filed by the Executive Branch against the Congress of the Republic. This controversy arose from the admission for processing of Motion No. 12090, which aimed to initiate the removal of then-President Martín Alberto Vizcarra Cornejo on the grounds of permanent moral incapacity, as stipulated in Article 113, paragraph 2 of the Constitution. The study will focus on analyzing the concept of presidential vacancy due to permanent moral incapacity, developing conceptual and doctrinal foundations related to the case, obtained through bibliographic sources, legal scholarship, and jurisprudence concerning the various interpretations of this concept. In this regard, the analysis of the Constitutional Court's ruling is of particular legal relevance, as it highlights the need to define the scope of this legal mechanism through verifiable normative criteria that strengthen legal certainty and reduce disparate interpretations within Parliament, with the aim of preserving a government with democratic stability. Therefore, this paper proposes amending Article 113 of the Constitution and Article 89-A of the Rules of Procedure of Congress by incorporating an objective definition, as well as uniform interpretive parameters that ensure the exceptional and consistent application of presidential vacancy, thus preventing its arbitrary application and strengthening the balance of power in our political system.
