“Conflicto Normativo Sobre la Validez de la Representación Unilateral en Donaciones a Menores de Edad”

Abstract

El presente trabajo analiza la Resolución Nº 052-2021-SUNARP-TR-A, emitida por el Tribunal Registral de la SUNARP, en relación con la aceptación de una donación pura y simple a favor de un menor de edad, representado únicamente por uno de sus padres. A partir de este caso, se examina el alcance de la patria potestad en el ordenamiento jurídico peruano, la representación legal de los menores, y los requisitos para la validez de los actos jurídicos cuando estos involucran a personas con capacidad restringida o incapacidad absoluta. El estudio se estructura en tres capítulos: el primero expone los antecedentes registrales y la posición del Tribunal Registral, sustentada en el precedente contenido en la Resolución Nº 350-2024-SUNARP/PT. El segundo desarrolla el marco teórico del acto jurídico, la capacidad de ejercicio, y el régimen de donaciones, abordando también las figuras de tutela, curatela y patria potestad. El tercer capítulo presenta un análisis crítico de la decisión adoptada por el Tribunal Registral, identificando posibles conflictos normativos. Finalmente, las autoras plantean recomendaciones orientadas a mejorar la práctica registral y garantizar mayor seguridad jurídica en la aceptación de donaciones a favor de menores de edad.

This paper analyzes Resolution No. 052-2021-SUNARP-TR-A, issued by the Registry Tribunal of SUNARP, regarding the acceptance of a pure and simple donation in favor of a minor, represented solely by one of their parents. Based on this case, the scope of parental authority in the Peruvian legal system, the legal representation of minors, and the requirements for the validity of legal acts when they involve persons with restricted capacity or absolute incapacity are examined. This analysis is structured in three chapters: the first one outlines the registry background and the position adopted by the Registry Tribunal, based on the precedent contained in Resolution No. 350-2024-SUNARP/PT. The second chapter develops the theoretical framework of the legal act, legal capacity, and the regime of donations, also addressing the figures of guardianship, curatorship and parental authority. The third chapter presents a critical analysis of the decision adopted by the Registry Tribunal, identifying potential normative conflicts. Finally, the authors offer recommendations aimed at improving registry practice and guaranteeing greater legal certainty in the acceptance of donations made in favor of minors.
