La Valoración Probatoria con Enfoque de Genero – El Caso de Angie Jibaja

Abstract

El caso que ha sido materia del presente trabajo académico, trata sobre el proceso judicial seguido en contra de Ricardo Márquez Michieli, por delito de Feminicidio en grado de tentativa en perjuicio de Angie Janinne Jibaja Liza y la subsecuente determinación de la responsabilidad penal del indicado imputado. En ese sentido, se analizara en primer lugar, cuales fueron los elementos de convicción recopilados por el Ministerio Publico, que le permitieron poder formalizar su caso en sede judicial y transitar hacia el juicio oral, donde se emitió una sentencia de primera instancia y después vía recurso de nulidad, conoció y resolvió en definitiva, una sala penal suprema, con lo cual, se cumplió la garantía procesal de la doble instancia, recordemos, que este suceso delictivo, aconteció el día 10 de Abril de 2020, cuando aún se encontraba vigente en el distrito judicial de Lima, el Código de Procedimientos Penales de 1940. A este respecto, también se analizarán las alegaciones jurídicas empleadas por la defensa técnica, cuando pretendió cuestionar el juicio de culpabilidad, en ese sentido, si dichos argumentos, encajaron con los medios probatorios recopilados y tuvieron entidad valorativa para cuestionar y rebatir la tesis de imputación fiscal. Finalmente, se analizarán los razonamientos jurídicos utilizados por los órganos jurisdiccionales de primera y segunda instancia, en lo que respecta a la aplicación de la ley, su interpretación y concordancia con las normas especiales sobre enfoque y perspectiva de género y el acatamiento o no, a las decisiones anteriores que constituyen jurisprudencia sobre la materia.

The case that has been the subject of this academic work addresses the judicial proceedings against Ricardo Márquez Michieli for the crime of attempted femicide against Angie Janinne Jibaja Liza and the subsequent determination of the aforementioned defendant's criminal liability.
