Afectación del Derecho Sucesorio en Transferencia de Propiedad ante Inefectividad de la Manifestación de Voluntad

Abstract

La investigación tiene como fin analizar la RESOLUCIÓN No. 1706-2023-SUNARP-TR Bagua, interpuesta por G.S.T, E.S.T y P.S.T a favor de sus coherederos N.L.S.T., F.S.T Y A.S.T. en el contexto del procedimiento de renuncia de acciones y derechos. El Tribunal Registral analiza la renuncia de un determinado inmueble ubicado en Bagua donde algunos herederos expresan la voluntad de renunciar a sus derechos sobre el bien en favor de otros coherederos. Posterior al análisis, el tribunal confirma la tacha sustantiva de la inscripción primigenia porque el acto, además de superar plazos legales establecidos por ley, tenía como finalidad transferir la propiedad a terceros (coherederos), configurándose un acto de donación. Sin embargo, en el análisis del voto en discordia se concluye que la solicitud debía ser efectiva dado que los renunciantes expresaron mediante escritura pública su voluntad de ceder sus derechos hereditarios a favor de los otros coherederos. Bajo este enfoque, se resalta el respeto a la autonomía de la voluntad de los otorgantes dentro del derecho sucesorio. La confrontación de los criterios jurisprudenciales fue determinante para que se considere realizar el análisis de los efectos de la transferencia de propiedad en el derecho sucesorio, y como la manifestación de voluntad causa un efecto en la misma. Finalmente, se concluye la importancia de clarificar la clasificación jurídica de los actos sucesorios con efectos traslativos de propiedad para proteger la manifestación de voluntad de los otorgantes de defectos que no se ajusten a la normativa vigente, evitando posibles inseguridades jurídicas o problemas registrales.

This research aims to analyze RESOLUTION No. 1706-2023-SUNARP-TR Bagua, submitted by G.S.T, E.S.T and P.S.T in favor of their co-heirs N.L.S.T., F.S.T and A.S.T. within the framework of a procedure concerning the renunciation of shares and rights. The Registry Tribunal examines the renunciation related to a specific property located in Bagua, in which some heirs express their intention to relinquish their rights over the asset in favor of other co-heirs. After reviewing the case, the tribunal confirms the substantive rejection of the initial registration, reasoning that the act, aside from exceeding the legal time limits established by law, effectively aimed to transfer ownership to third parties (co-heirs), thereby constituting a donation. However, in the analysis of the dissenting vote, it was concluded that the application should be considered valid, as the renouncing parties had clearly and unequivocally expressed—through a notarized public deed—their will to transfer their hereditary rights to other co-heirs. From this perspective, the principle of autonomy of will within inheritance law is emphasized. The divergence in the tribunal’s jurisprudential criteria highlighted the need to examine the legal effects of ownership transfer within the framework of inheritance law, particularly how the expression of will can have substantive legal consequences. In conclusion, the study underscores the importance of clarifying the legal classification of succession-related acts that involve the transfer of ownership, in order to safeguard the will of the parties from procedural or substantive defects that could result in legal uncertainty or registration issues.
