La Necesidad de Mejorar los Criterios del Debido Proceso Partiendo del Análisis de la Casación N°3854-2021

Abstract

El presente Trabajo de Suficiencia Profesional tiene como objetivo realizar el análisis del pronunciamiento emitido por la Corte Suprema en la Casación Nº 3854 - 2021, respecto al recurso de casación interpuesto por la Empresa Construcciones e Inversiones V&E S.A.C., en un proceso sobre nulidad de acto jurídico contra la sentencia de vista emitida por la Tercera Sala Civil de la Corte Superior de Justicia de Lima. El recurrente al considerar que se han constituido infracciones normativas, así como procesales y sustantivas alega que se ha afectado el debido proceso y por ende la validez de la sentencia de vista impugnada. A propósito de la elaboración de nuestro trabajo; se ha llevado a cabo una exhaustiva recopilación de la normativa aplicable para nuestro estudio; así como doctrina jurídica y jurisprudencia. En este sentido hemos obtenido una visión integral de nuestro análisis garantizando su validez, así como su aplicabilidad en nuestro escenario de transferencia de propiedad y contratos de compraventa. Nuestro análisis de la Casación N° 3854 - 2021 está centrado en la postura de los magistrados; en este sentido, nosotros compartimos la postura de los votos mayoritarios; ya que se identifican que las afirmaciones para sustentar la casación no vulneran algún derecho durante el proceso. Nosotros compartimos su perspectiva debido a que consideramos importante no solo contradecir la sentencia mediante los hechos del caso, sino también se debe señalar un medio probatorio que compruebe la vulneración del derecho que ha ocasionado la sentencia.

The present Professional Proficiency Report aims to analyze the ruling issued by the Supreme Court in Cassation No. 3854 - 2021, regarding the cassation appeal filed by the company Construcciones e Inversiones V&E S.A.C., in a proceeding concerning the annulment of a legal act against the appellate judgment rendered by the Third Civil Chamber of the Superior Court of Justice of Lima. The appellant, considering that both procedural and substantive legal violations have occurred, argues that due process has been infringed, thereby affecting the validity of the challenged appellate judgment. In preparing this report, an exhaustive compilation of the applicable legal framework has been carried out, including relevant legal doctrine and jurisprudence. Accordingly, we have gained a comprehensive understanding of the case, ensuring the validity and practical relevance of our analysis within the context of property transfer and sales contracts. Our analysis of Cassation Appeal No. 3854 - 2021 focuses on the position of the judges; in this sense, we share the position of the majority, as they identify that the statements supporting the cassation appeal do not violate any rights during the proceedings. We share their perspective because we believe it is important not only to refute the judgment through the facts of the case, but also to provide evidence that proves the violation of the right that led to the judgment.
