Análisis textual de corpus bilingüe comparable de actas constitutivas de empresas en Lima (Perú) y Miami (Estados Unidos)

Abstract

La traducción de actas jurídicas depende de la equivalencia funcional y terminológica entre sistemas legales distintos. Para ello, los corpus bilingües permiten a identificar patrones lingüísticos y terminológicos para conseguir una traducción funcional. Y, aunque a nivel internacional se han logrado avances en la identificación de patrones lingüísticos y terminológicos para la traducción jurídica, en el ámbito nacional aún faltan investigaciones sobre este tema. Por ello, esta investigación propone realizar un análisis textual de un corpus bilingüe comparable de actas constitutivas de empresas en Lima (Perú) y Miami (Estados Unidos), con el objetivo de identificar y comparar las diferencias y semejanzas en su macroestructura y microestructura, lo cual permitirá comprender cómo las diferencias entre los sistemas legales de ambos países influyen en la organización del contenido y en el uso de terminología específica, contribuyendo a una traducción jurídica más precisa y funcional. Se parte del supuesto de que la macroestructura de un texto jurídico se refiere a la organización general del contenido, su distribución y la coherencia discursiva; asimismo, que las diferencias microestructurales pueden observarse en el uso de términos legales específicos de cada jurisdicción y en las construcciones sintácticas. En ese sentido, se emplearon cuatro categorías teóricas: el uso de corpus para identificar patrones lingüísticos; el género textual como estructura discursiva; el análisis textual contrastivo para explorar diferencias interlingüísticas; la macroestructura enfocada en la organización global del texto, la microestructura, que abarca elementos cohesivos y terminológicos específicos, y un panorama del derecho anglosajón y peruano.

The translation of legal documents depends on the functional and terminological equivalence between different legal systems. To this end, bilingual corpora allow the identification of linguistic and terminological patterns in order to achieve a functional translation. And, although international progress has been made in identifying linguistic and terminological patterns for legal translation, national research on this topic is still lacking. Therefore, this research proposes to carry out a textual analysis of a comparable bilingual corpus of corporate articles of incorporation in Lima (Peru) and Miami (United States), with the aim of identifying and comparing the differences and similarities in their macrostructure and microstructure, which will allow us to understand how the differences between the legal systems of both countries influence the organization of the content and the use of specific terminology, contributing to a more precise and functional legal translation. It is assumed that the macrostructure of a legal text refers to the general organization of the content, its distribution and discursive coherence; Likewise, microstructural differences can be observed in the use of legal terms specific to each jurisdiction and in syntactical constructions. In this sense, four theoretical categories were used: the use of corpora to identify linguistic patterns; textual genre as a discursive structure; contrastive textual analysis to explore interlinguistic differences; macrostructure focused on the overall organization of the text; microstructure, which encompasses specific cohesive and terminological elements; and an overview of Anglo-Saxon and Peruvian law.
