Afectación al derecho a la libertad personal a propósito de la sentencia del pleno 380/2021

Abstract

El presente informe ofrece un análisis de los conceptos clave relacionados con la discapacidad mental, así como de las normativas y problemas legales que les afectan. Se examina la relación entre los hechos y la decisión del Tribunal Constitucional en la Sentencia 380/2021, proporcionando un marco para entender los desafíos en el tratamiento e internamiento de pacientes con trastornos de esquizofrenia y su impacto en el derecho a la libertad personal. Este análisis busca promover una mayor comprensión y reconocimiento de los derechos de las personas con discapacidad mental. Además, se evalúa cómo la normativa nacional en materia de salud mental protege la libertad personal de los individuos con trastornos mentales, subrayando la importancia de garantizar su autonomía a través del consentimiento informado en las decisiones que conciernen a su atención y al ingreso en instituciones de salud mental. El informe enfatiza la necesidad de implementar ajustes razonables y adoptar un enfoque centrado en los derechos humanos para asegurar un trato digno y respetuoso hacia las personas con discapacidad mental, en línea con los principios de la Convención sobre los Derechos de las Personas con Discapacidad.

The present report offers an analysis of key concepts related to mental disability, as well as the regulations and legal issues that affect them. It examines the relationship between the facts and the decision of the Constitutional Court in Ruling 380/2021 380/2021, providing a framework to understand the challenges in the treatment and internment of patients with schizophrenia disorders and their impact on the right to personal freedom. This analysis aims to promote greater understanding and recognition of the rights of people with mental disabilities. Additionally, it evaluates how national mental health regulations protect the personal freedom of individuals with mental disorders, emphasizing the importance of ensuring their autonomy through informed consent in decisions regarding their care and admission to mental health institutions. The report highlights the need to implement reasonable accommodations and adopt a human rights-based approach to ensure dignified and respectful treatment of individuals with mental disabilities, in line with the principles of the Convention on the Rights of Persons with Disabilities.
