En el presente trabajo, se analizará, a propósito de la Sentencia emitida en la Casación N° 4627-2019 por la Corte Suprema de Justicia, si es posible aplicar el Principio Iura Novit Curia para reenviar una controversia que fue planteada en sede judicial a arbitraje, a pesar de que la demandada no dedujo oportunamente la excepción de convenio arbitral. Al respecto, se explicarán los fundamentos desarrollados en la primera y segunda instancia, así como el razonamiento jurídico seguido por la Corte Suprema de Justicia en la sentencia emitida en casación y en el voto singular. Y, de la misma manera, se analizará el marco jurídico aplicable a dicha sentencia. Luego de lo cual, se emitirá una opinión y una crítica sobre el voto singular de la casación, en la que concluye que sí es posible invocar el Principio de Iura Novit Curia sobre una excepción de convenio arbitral que no fue invocada por la demandada.In the present work, we will analyze, based on sentence issued in the Cassation No. 4627-2019 by the Supreme Court of Justice, whether it is possible to apply the Iura Novit Curia Principle to refer a dispute that was raised in judicial proceedings to arbitration, despite the fact that the defendant did not timely raise the objection of the arbitration agreement. In this regard, the legal basis in the first and second instance will be explained, as well as the legal reasoning followed by the Supreme Court of Justice in the ruling issued on cassation and its separate opinion. Similarly, the legal framework applicable to that ruling will be analyzed. Afterward, an opinion and critique will be presented on the singular opinion in the cassation, which concludes that it is indeed possible to apply the Iura Novit Curia Principle regarding an arbitration agreement objection that was not raised by the defendan
