The Impact of the Denaturalization of Fixed-term Employment Contracts Based on the Analysis of Cassation No. 14714-2019Abstract
En el presente trabajo se analiza el fallo emitido en sede casatoria, en el cual se evaluó la reposición laboral del Sr. Luis Gallardo Faichn, producto de la desnaturalización de su Contrato Temporal, siendo este el demandante y la empresa Casa Grande S.A.A., el demandado. El accionante alegó haber sido víctima de un despido intempestivo, sin previo aviso, ni causa justificada, lo que configuraría un despido incausado. Para abordar esta problemática, se examinaron conceptos doctrinales y normativos relacionados a los derechos laborales presentes en los contratos sujetos a modalidad. Por ello, se realizó el análisis completo de la interrelación de fuentes generales del Derecho, con la materia vista, dado que es prioridad mantener la objetividad en todo pronunciamiento judicial, debido a que esto es pilar, en el que se manifiesta la justicia, en un Estado de Derecho. Con relación a lo mencionado, nuestra conclusión indica que los Contratos por Temporada deben cumplir con los fines específicos inherentes a su naturaleza jurídica. De no observarse correctamente los supuestos establecidos en la normativa que los regula, las empresas contratantes podrían incurrir en fraude a la ley, lo que conlleva a la desnaturalización de los contratos sujetos a modalidad, afectando gravemente los derechos laborales de los trabajadores. Para el desarrollo de esta investigación, se consultaron diversas fuentes, tales como artículos jurídicos, libros especializados, normativa y jurisprudencia relevante. En consecuencia, posterior al análisis de la presente Casación, compartimos la postura expresada en el voto en discordia emitido.This paper analyzes the ruling issued in the cassation court, in which the reinstatement of Mr. Luis Gallardo Faichn was assessed, as a result of the denaturalization of his Temporary Contract, being the plaintiff and the company Casa Grande S.A.A., the defendant. The plaintiff claimed to have been the victim of an untimely dismissal, without prior notice or justified cause, which would constitute an unjustified dismissal. To address this problem, doctrinal and normative concepts related to labor rights present in Contracts subject to modality were examined. Therefore, a complete analysis of the interrelation of general sources of law with the subject matter was carried out, given that it is a priority to maintain objectivity in all judicial pronouncements, because this is the pillar in which justice is manifested in a State of Law. In relation to the above, our conclusion indicates that Seasonal Contracts must comply with the specific purposes inherent to their legal nature. If the assumptions established in the regulations that govern them are not correctly observed, the contracting companies could incur in fraud of the law, which leads to the denaturalization of contracts subject to modality, seriously affecting the labor rights of workers. For the development of this investigation, various sources were consulted, such as legal articles, specialized books, regulations and relevant jurisprudence. Consequently, after the analysis of this Cassation, we share the position expressed in the dissenting vote issued.
