Análisis e Implicancias actuales del caso Olivera Fuentes vs. Perú sobre igualdad y no discriminación LGBTIQ

Abstract

El presente trabajo de investigación tiene como finalidad realizar un análisis jurídico, de cómo una caso discriminatorio de un miembro que forma parte del colectivo LGBTIQ, luego de agotar todos los recursos ofrecidos por Perú y las normas pertinentes. Recurre al derecho supranacional, a través de la Corte IDH y pueda tutelar los derechos que no fueron garantizados por la justicia nacional. Es por ello que, tras observar el proceso administrativo y judicial del aparato estatal peruano, se determinó que el Estado peruano violó los derechos del demandante. Asimismo, se destaca el respeto a la igualdad ante la ley y no discriminación de las personas sin importar su sexualidad en cualquier espacio del territorio peruano. En el fallo, se ordena el pago de la indemnización al demandante y una serie de medidas que debe cumplir el Estado, para que este tipo de actividades no vuelvan a ocurrir en un futuro próximo y establecer como un precedente en caso existan situaciones similares. Haciendo hincapié en que la Corte supervisará que su decisión sea cumplida en su totalidad. Es por ello que, esta sentencia es un paso favorable para los integrantes de la comunidad LGBTIQ y para todas las personas que puedan sufrir una violación a sus derechos fundamentales. Esto por parte de las entidades que ostentan un grado mayor de poder frente a las personas comunes, que también se encuentran protegidas.

The purpose of this research work is to carry out a legal analysis of how a discriminatory case of a member of the LGBTIQ community, after exhausting all the resources offered by Peru and the relevant norms. It resorts to supranational law, through the IACHR Court and can protect the rights that were not guaranteed by the national justice system. Therefore, after observing the administrative and judicial process of the Peruvian State apparatus, it was determined that the Peruvian State violated the plaintiff's rights. Likewise, it highlights the respect for equality before the law and non-discrimination of persons regardless of their sexuality in any area of Peruvian territory. The ruling ordered the payment of compensation to the plaintiff and a series of measures that the State must comply with, so that this type of activities do not happen again in the near future and establish a precedent in case there are similar situations. Emphasizing that the Court will supervise that its decision is fully complied with. Therefore, this ruling is a favorable step for members of the LGBTIQ community and for all persons who may suffer a violation of their fundamental rights. This by entities that hold a greater degree of power over ordinary people, who are also protected.
