Pregnant Women and the Conceived: Impact on Their Rights by CITENAbstract
En la actualidad, las mujeres son víctimas de discriminación durante el estado de gestación en etapa de formación académica profesional; sin embargo, en pocas oportunidades, se menciona la afectación del concebido, quien es un sujeto de derecho y recibe protección jurídica como ser indefenso, condicionado a nacer. El presente trabajo de investigación analiza la valoración de los derechos vulnerados del concebido, a consecuencia de la expulsión de una estudiante gestante del CITEN. El objeto de investigación es el concebido, dado que el magistrado Sardón emite un voto singular, y realiza una breve mención de este sujeto de derecho, y concluye, por otras razones, con el voto mayoritario. De un análisis efectuado al presente caso, se evidencia que los máximos intérpretes de la Constitución no han respetado la protección jurídica del concebido, generando un estado de indefensión. Por lo que, se concluye que el TC ha vulnerado al concebido como sujeto de derecho, al no evaluar su situación de forma independiente respecto a la gestante; de esta manera, se recomienda la creación de alternativas preventivas y de solución, tales como: modificar las políticas institucionales de los centros de formación militar e implementar medidas y/o programas de apoyo académico y profesional.Currently, women are victims of discrimination during pregnancy while pursuing their professional academic formation; however, the impact on the conceived, who is a subject of rights and receives legal protection as a defenseless being conditioned to be born, is rarely mentioned. This research examines the assessment of violated rights of the conceived resulting from the expulsion of a pregnant student from CITEN. The focus of the study is on the conceived, as Justice Sardon issues a dissenting opinion, briefly addressing this rights-bearing individual and concluding, for other reasons, in line with the majority opinion. An analysis of the current case reveals that the highest interpreters of the Constitution have not respected the legal protection of the conceived, leading to a state of vulnerability. Therefore, it is concluded that the Constitutional Court has infringed upon the conceived as a rights-bearing individual by not independently evaluating their situation in relation to the pregnant student. Consequently, it is recommended to establish preventive and remedial alternatives, such as modifying institutional policies in military training centers and implementing measures o programs to support academic and professional endeavors.
