La responsabilidad social del Colegio de Notarios y la importancia del pro bono en la función notarial para el correcto desarrollo de la actividad testamentaria en Ayacucho

Abstract

En el siglo XII en Bolonia, surge el Publicus Notarius que ostenta la fe pública obtenida por una actividad llevada a cabo durante muchos años basada en la realidad y necesidad social, que la población reconoce como benéfica; luego ante su bien hacer, el Estado lo reconoció como conductor de una función pública.

Entre las funciones del notario se encuentra la de realizar diversos documentos, siendo uno de ellos el testamento, acto jurídico donde se expresa el futuro que una persona ha decidido tengan sus bienes una vez fallezca. Existen diversos tipos regulados en el Código Civil, los cuales tienen en común que parten de la premisa de que el testador está ejerciendo su plena voluntad. Al ser el Código Civil un instrumento público se espera ser conocido por todos los ciudadanos, sin embargo, la realidad ayacuchana ignora la complejidad de este acto jurídico y ante este problema social el notario debiera actuar, una vez más, en beneficio de la sociedad.

La presente investigación tiene como base el análisis de la responsabilidad social del Colegio de Notarios con respecto a la realización de testamentos y la importancia del pro bono en la función notarial en Ayacucho. Los notarios interactúan constantemente con la sociedad. por lo que se considera que el ejercicio de su profesión desempeña un rol de enseñanza fundamental entre la sociedad y el derecho.

In the XII century in Bologna, the Publicus Notarius arises, who holds the public faith obtained by an activity carried out for many years based on reality and social need, which the population recognizes as beneficial; then, in view of his or her good work, the State recognized him or her as the one who exercises a public function.

The Notary, in the exercise of his or her functions, prepares different documents, one of them being the will. This is legal act, by which a person disposes of his or her assets after his or her death. There are various types of wills regulated on the Civil Code, each one of them with its own formalities, but all of them are based on the premise that the testator is exercising full freedom of choice, a decision that brings with it advantages such as; that of expressing the last will of the testator in a document, safeguarded by a notary; as well as disadvantages. The reality of Ayacucho ignores the complexity of a law and in the face of this social problem the notary must act, once again, for the benefit of society.

This research is based on the analysis of the social responsibility of the Association of Notaries Public with respect to the execution of wills in Ayacucho. The notaries interact constantly with society and for this reason they cannot disregard the reality faced by society.
