El presente trabajo versa sobre la denuncia interpuesta por CAYMAN S.A.C. contra SOUTH PACIFIC MOTOR PERÚ S.A.C. y LIMAUTOS AUTOMOTRIZ DEL PERÚ S.A.C. por infracción a los derechos de Propiedad Industrial respecto al signo “ZS”. En particular, la denunciante sostuvo que era titular de una familia de marcas constituida por el elemento común “ZS” y que, dicha familia de marcas, había sido previamente reconocida por el INDECOPI mediante la Resolución N° 2891-2019/CSD-INDECOPI. A lo largo del procedimiento, se declaró el abandono del procedimiento contra LIMAUTOS. Posteriormente, la Comisión de Signos Distintivos declaró FUNDADA la denuncia interpuesta contra SOUTH PACIFIC, analizando los medios probatorios de la visita inspectiva realizada y tras verificar que existían vehículos con el signo ZS. Asimismo, sancionó a SOUTH PACIFIC con una multa de 150 UIT. Sin embargo, distinta fue la decisión de la Sala Especializada en Propiedad Intelectual debido a que revocó la decisión de la Comisión y declaró INFUNDADA la denuncia, sobre la base de que las letras MG cumplen la función de signo distintivo y las letras ZS sólo identificaba el modelo del vehículo.This work deals with the complaint filed by CAYMAN S.A.C. against SOUTH PACIFIC MOTOR PERÚ S.A.C. and LIMAUTOS AUTOMOTRIZ DEL PERÚ S.A.C. for infringement of Industrial Property rights with respect to the sign "ZS". In particular, the plaintiff argued that it was the owner of a family of trademarks consisting of the common element "ZS" and that said family of trademarks had been previously recognized by INDECOPI through Resolution No. 2891-2019/CSD-INDECOPI. Throughout the procedure, it was declared the abandonment of the procedure against LIMAUTOS. Subsequently, the Distinctive Signs Commission declared the complaint filed against SOUTH PACIFIC FOUNDED, analyzing the evidentiary means of the inspection visit carried out and after verifying that there were vehicles with the ZS sign. Likewise, it sanctioned SOUTH PACIFIC with a fine of 150 UIT. However, the decision of the Specialized Chamber on Intellectual Property was different because it revoked the decision of the Commission and declared the complaint UNFOUNDED, on the basis that the letters MG fulfill the function of a distinctive sign and the letters ZS only identified the vehicle model.
