La responsabilidad civil, es una institución jurídica destinada para reparar o resarcir aquel daño o perjuicio causado contra otro sujeto, específicamente en su vertiente extracontractual se han considerado múltiples situaciones las cuales pueden causar severas afectaciones en los sujetos víctimas. El daño es reconocido como elemento esencial y constitutivo de la responsabilidad civil, implica la vulneración de un interés jurídicamente protegido como hecho generador de un perjuicio o consecuencia negativa en la esfera jurídica de un tercero. La determinación del daño a la persona y daño moral, ambos entendidos como daño no patrimonial, ha sido una constante problemática en la institución jurídica de la responsabilidad civil, debido a su carácter subjetivo y aparentemente no pasible de resarcimiento. Sin embargo, resulta preciso considerar la implicancia de la integridad y dignidad humana en él vulnerados, por lo que se evidencia la urgencia de una tutela resarcitoria.Civil liability is a legal institution destined to repair or compensate that damage or injury caused against another subject, specifically in it is extra- contractual aspect, and multiple situations have been considered which can cause severe effects on the victim subjects. Damage is a recognized as an essential and constitutive element of civil liability implies the violation of a legally protected interest as a fact generating damage or negative consequence in the legal sphere of another person. The determination of the damage to the person and moral damage, both understood non- patrimonial damage, has been a constant problem in legal institution of civil liability, due to it is subjective nature and apparently not liable to compensation. However, it is necessary to consider the implication of the violated integrity and human dignity, which is why the urgency of a compensatory protection is evident
