dc.description.abstractExisten situaciones durante la gestión de las contrataciones públicas que conllevan a que los responsables del área encargada de las contrataciones, se aparten de la normativa que regula las compras públicas durante su ejecución. Uno de los escenarios identificados a partir del presente trabajo de investigación y que captó nuestra atención, lo constituyen aquellos casos en los que nos encontraremos frente a proveedores que pese a haber cumplido con las prestaciones a su cargo, no reciben la contraprestación correspondiente de parte de la Entidad, ya sea porque no se cuenta con contrato suscrito, o porque no se ha emitido ninguna orden de compra o de servicio. Por tanto, al no contar con la documentación pertinente que sustente el pago correspondiente por la prestación recibida por el proveedor, la Entidad resulta ser pasible de protagonizar o dar vida a una posible acción legal bajo la figura del enriquecimiento sin causa, institución jurídica del derecho civil, que no ha sido soslayada por este sistema administrativo, y que resulta ser frecuentemente utilizada por los proveedores en esta materia. A fin de entender cómo opera la precitada acción, y de qué forma afecta al sector salud, el presente estudio desarrolla los aspectos de orden académico y doctrinal más relevantes de la figura en mención, para finalmente presentar una propuesta de mejora de carácter técnico – normativo, que sirva de base para atender dichas situaciones, sin que se generen mayores gastos en recursos (econen_US
dc.description.abstractAbstrac: There are situations during the management of public procurement that have as a consequence that those responsible for the area in charge of procurement, whether it is the logistics or supply area, do not follow the rules that regulate public procurement during its execution. One of the cases identified from this research work and that caught our attention, are those cases in which we will find ourselves in front of suppliers who, despite having fulfilled their obligations, do not receive the corresponding payment from the Entity, either because there is no signed contract, or because no purchase or service order has been issued. In that sense, by not having the relevant documentation to support the corresponding payment for the benefit received by the provider, the Entity turns out to be liable to lead or give life to a possible legal action under the figure of enrichment without cause, legal institution of the civil law, which has not been ignored by this administrative system, and which turns out to be frequently used by suppliers in this matter. In order to understand how the aforementioned action operates, and how it affects the health sector, the present study develops the most relevant academic and doctrinal aspects of the figure in question, to finally present a proposal for improvement of technical - regulatory nature, which serves as a basis for addressing these situations, without generating greater expenditure on resources (economic and human) in the entity chosen as the focal point of our research.en_US
