Los artículos 3 y 18.2 del DL 1033 (DECRETO LEGISLATIVO QUE APRUEBA LA LEY DE ORGANIZACIÓN Y FUNCIONES DEL INSTITUTO NACIONAL DE DEFENSA DE LA COMPETENCIA Y DE LA PROTECCIÓN DE LA PROPIEDAD INTELECTUAL) son normas que han establecido que la competencia para conocer los procesos con el INDECOPI es de exclusividad de los juzgados ubicados en la ciudad de Lima, este suceso genera de por sí una barrera de acceso a la justicia y por tanto una afectación al derecho a la Tutela Jurisdiccional Efectiva, ya que el ciudadano que reside en diferentes regiones del Perú debe recurrir a formular las demandas judiciales contra el INDECOPI a la ciudad de Lima, lo que ocasiona un costo adicional para el acceso a la justicia, pues una persona deberá trasladarse desde la región en que reside hasta la ciudad de Lima asumiendo el valor económico que ello implica, además por el traslado se le genera demora adicional en su trámite judicial, y , finalmente se le otorga una ventaja injustificada al INDECOPI, que como parte del estado tiene todas las ventajas de litigar en cualquier parte del país, sobre todo en los lugares donde tiene una sede regional.Articles 3 and 18.2 of DL 1033 (LEGISLATIVE DECREE APPROVING THE LAW OF ORGANIZATION AND FUNCTIONS OF THE NATIONAL INSTITUTE FOR THE DEFENSE OF COMPETITION AND THE PROTECTION OF INTELLECTUAL PROPERTY) are norms that have established that the competence to know the processes with the INDECOPI is exclusive of the courts located in the city of Lima, this event generates in itself a barrier of access to justice and therefore an affectation to the right to Effective Jurisdictional Guardianship, since the citizen residing in different regions of the Peru must resort to formulating the lawsuits against INDECOPI to the city of Lima, which causes an additional cost for access to justice, since a person must move from the region where he lives to the city of Lima, assuming the cost that implies, in addition to the transfer is generated additional delay in its judicial process, and, finally, an unjustified advantage is granted to INDECOPI, that as part of the state it has all the advantages of litigating in any part of the country, especially in the places where it has a regional headquarters.
