Determinar si la corrupción que se presenta en la contratación pública, además de ser una externalidad, constituye una barrera burocrática, y como ésta afecta el crecimiento económico y la calidad de los servicios públicos. Para identificar a la corrupción como una barrera burocrática en las contrataciones públicas, hemos analizado un marco teórico jurídico, ético y económico, así como que hemos descrito cómo se realizan los procesos de selección para que los diversos estamentos del Estado puedan proveerse de bienes, servicios y ejecutar obras en beneficio de bien común y el interés general. Hemos identificado y evaluado los problemas que se generan en relación a los actos de corrupción en las contrataciones con el Estado, de tal forma que hemos podido corroborar que la corrupción constituye una barrera burocrática, así como que es una externalidad negativa, por cuanto si bien se beneficia el corruptor y corrompido, ello representa para el sistema de contratación pública y para la sociedad, asumir los altos costos en perjuicio para la sociedad y sistema legal; además de impactar negativamente en el desarrollo económico, generándose la falta de competencia, lo cual restringe el acceso de los agentes económicos al mercado, impidiendo la pluralidad de postores, derivando ello en la deficiencia en los servicios y en la ejecución de las obras.Determine if the corruption that occurs in public recruitment, besides being an externality, it establishes a bureaucratic barrier, and how it affects economic growth and the good quality of public services. In order to be able to identify corruption as a bureaucratic barrier in public recruitment, we have analyzed a legal, ethical and economic theorist framework, as well as describing how selection processes are accomplished so that the various State entities can provide themselves with goods, services and execute works to benefit the common good and the whole general interest. We have identified and evaluated the problems that are generated in relation to acts of corruption in public recruitment, in such a way that we have been able to corroborate that corruption constitutes a bureaucratic barrier, as well as that it is a negative externality, while it is true the corrupter and corrupted both are benefited, it represents for the system of public recruitment and for society too, to take over the high costs in damage for society and legal system; besides having a negative impact on economic development, as a result generating a lack of competition, which restricts the access of economic agents to the market, inhibiting the plurality of bidders and suppliers, resulting in a deficiency in services and performing of works.
